When discussing acts that drafters should have exclusive rights to, Vinnie the Eel included Destroyer and they were added to the Exclusive Rights Free Agent List.
Wikipedia has Dan Bejar listed as inactive from New Pornographers.
Rule 3 states:
3) If there is a collective that has members that do not tour with it but do play with other projects or as a solo artist, then it should be assumed that the non-touring members are not drafted as part of the collective.
Other drafters have alleged that they were going to pick up Destroyer as a free agent but did not do so due to their presence on the ERFA list.
The question becomes, who has access to Destroyer?
* Nobody? They should have been available and should not have been on the ERFA list. Vinnie the Eel shouldn't benefit from having them on the list dissuading others from selecting them and it would not be fair to only award them to someone who did not consult the list when others wanted them.
* Vinnie the Eel? Dan Bejar should still be considered part of New Pornographers and he is the only one with rights to them. They were correctly placed on the ERFA list.
* Anybody that selected them? They should not have been considered an exclusive act so there was no reason to see if they were on the list. If anybody thought that they shouldn't be there but didn't question it then it's their loss. Anybody that selected them should have them.
* Anybody that wants them? They should not have been considered an exclusive act but people who didn't select them because they were following the rules shouldn't be punished. If anybody wants to swap out an act for them they can.

false, me and hambone both thought Destroyer wasn't involved and said as much. but it went no further so I just dropped it.
